Terms of Use

1. Acceptance of Terms

By accessing or using any FaceAccess product or service — including FaceAccess Home, FaceAccess Business, FaceAccess Mobile, or any associated web application ("Services") — you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, our Biometric Data Retention Policy, and our AI & Facial Recognition Disclosure. If you do not agree, you may not use the Services.

2. Description of Services

FaceAccess provides biometric identity verification and access control services including:

• FaceAccess Home — Facial recognition-based smart home access for residential properties
• FaceAccess Business — Enterprise access control and employee identity management
• FaceAccess Mobile — Mobile application for remote access management and enrollment
• FaceAccess Web Dashboard — Administrative portal for managing users, doors, and access events

3. Eligibility

You must be at least 18 years of age to create an account independently. Users between 13 and 17 may only use the Services with verifiable parental or guardian consent. Use by children under 13 is prohibited. By using the Services, you represent that you meet these eligibility requirements.

4. Account Registration

To use the Services, you must create an account and provide accurate, complete, and current information including your name, email address, and where applicable, a phone number. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying FaceAccess immediately of any unauthorized access at support@faceaccess.com

5. Biometric Data Consent

By enrolling your facial biometric data, you expressly consent to:

• The collection, processing, and storage of your facial biometric identifiers and biometric information
• The conversion of your facial imagery into an encrypted 128-dimensional mathematical template used solely for identity verification
• Retention of your biometric template in accordance with our Biometric Data Retention Policy
• The use of AI-powered facial recognition algorithms as described in our AI & Facial Recognition Disclosure

You may withdraw biometric consent at any time by removing your facial enrollment through your account settings or by contacting support@faceaccess.com. Withdrawal does not retroactively affect past processing.

6. SMS Communications Consent

If you provide a mobile phone number, you consent to receive SMS text messages from FaceAccess including security codes, authentication alerts, account notifications, and service updates. By providing your phone number and checking the SMS consent checkbox during registration or onboarding:

• You agree to receive recurring automated SMS messages from FaceAccess at the phone number provided
• Message frequency varies based on account activity
• Message and data rates may apply
• You may opt out at any time by replying STOP to any FaceAccess message
• Reply HELP for help or contact support@faceaccess.com
• SMS consent is not a condition of purchasing or using the core Services

7. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to bypass, circumvent, or defeat facial recognition or liveness detection systems
• Submit fraudulent biometric data, including photos, videos, or spoofing attempts
• Enroll biometric data for another person without their explicit written consent
• Probe, scan, or test the vulnerability of the Services without authorization
• Use automated scripts, bots, or tools to interact with the Services in unauthorized ways
• Attempt to reverse-engineer, decompile, or extract proprietary algorithms

8. Intellectual Property

All content, software, algorithms, and technology within the Services are the exclusive property of FaceAccess or its licensors and are protected by applicable intellectual property laws. You may not copy, distribute, modify, or create derivative works from any portion of the Services without express written permission.

9. Third-Party Services

The Services may use third-party providers for infrastructure (Cloudflare), SMS delivery (Twilio), and other functionality. Your use of such third-party services is subject to their respective terms and policies. FaceAccess is not responsible for third-party service failures, outages, or errors.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FACEACCESS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Indemnification

You agree to indemnify, defend, and hold harmless FaceAccess and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your violation of these Terms, your use of the Services, or your infringement of any third-party rights.

13. Privacy

Your use of the Services is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Services, you also consent to the data practices described in our Privacy Policy.

14. Account Termination

FaceAccess reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that endangers the safety or integrity of the platform. You may delete your account through your account settings, which will trigger biometric data deletion in accordance with our Biometric Data Retention Policy.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

16. Changes to Terms

FaceAccess reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
